Please read these Terms of Service carefully before booking a consultation or using any Fresh Turf service. By scheduling an appointment, signing up for a maintenance plan, or using our website, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Fresh Turf (“Fresh Turf,” “we,” “us,” or “our”), a turf sanitation and maintenance company operating in Houston, Texas.

By accessing our website, completing a consultation form, or engaging us for any service, you represent that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with these Terms.

2. Services Offered

Fresh Turf provides professional artificial turf care services for residential properties in the Houston, Texas metropolitan area. Our services include:

Turf Sanitation — Deep cleaning, enzyme-based odor treatment, and bacteria reduction targeting pet urine buildup
Restoration and Grooming — Fiber lifting, infill redistribution, surface leveling, and power grooming to restore turf appearance
Turf Repair — Inspection for and repair of seam separation, edge lifting, drainage issues, and high-traffic wear
Recurring Maintenance Plans — Scheduled ongoing care on a monthly, bi-monthly, or quarterly basis

All services are performed by trained Fresh Turf technicians. We reserve the right to decline or modify a service request if, in our professional judgment, the requested scope is not appropriate, safe, or feasible for the condition of the turf.

3. Scheduling and Property Access

Consultations
Initial consultations are conducted by phone or video. To schedule, you must complete our Turf Health Assessment form at freshturf.com. We will contact you within one (1) business day to confirm your consultation time.

Service Appointments
Service appointments are confirmed via email or phone. By confirming an appointment, you authorize Fresh Turf technicians to access your property on the agreed date and time for the purpose of performing the booked service.

Property Access Requirements

You agree to provide safe, unobstructed access to the artificial turf area on the day of service. This includes:

Ensuring pets are secured or removed from the turf area prior to our arrival
Removing toys, furniture, or other objects from the turf surface
Ensuring a functioning water source (outdoor spigot) is accessible if required for the service
Notifying us of any known hazards, structural concerns, or access restrictions on your property

If our technician cannot safely access the turf area upon arrival due to conditions within your control, a trip fee may apply (see Section 5).

4. Limitation of Liability

To the fullest extent permitted by applicable law, Fresh Turf’s total liability to you for any claim arising from our services or these Terms shall not exceed the total amount paid by you for the specific service giving rise to the claim.

Fresh Turf shall not be liable for:

Pre-existing damage to artificial turf, infill, drainage systems, or surrounding landscaping not caused by our technicians
Damage resulting from conditions you failed to disclose at time of booking (including turf defects, seam issues, or drainage blockages)
Results that vary from expectations due to turf age, manufacturer quality, or conditions beyond our control
Indirect, consequential, incidental, or punitive damages of any kind
Any damage or injury resulting from your failure to secure pets or clear the work area as required in Section 3

No Guarantee of Specific Results
While we apply professional-grade treatments and methods, we do not guarantee complete or permanent odor elimination, full fiber restoration, or specific aesthetic outcomes. Results vary based on turf age, prior maintenance history, pet usage volume, and environmental conditions.

5. Property Conditions and Disclosure

You agree to truthfully disclose the condition of your turf and property during the consultation and at time of service. This includes known damage, prior repair attempts, use of home remedies or third-party chemicals, and any accessibility concerns. Undisclosed conditions that result in added scope of work may be subject to additional charges, and Fresh Turf shall not be held responsible for complications arising from undisclosed issues.

Our technicians will not perform work in conditions deemed unsafe, including during active lightning, flooding, or extreme weather events. In such cases, we will reschedule at no charge to you.

6. Website Use

Your access to and use of freshturf.com is subject to the following conditions:

You may use our website for lawful purposes only and in a manner consistent with these Terms
You may not attempt to access restricted areas of the site, submit false information, or interfere with the site’s functionality
All content on our website — including text, images, logos, and service descriptions — is the property of Fresh Turf and may not be reproduced without written permission
Our website is provided “as is.” We make no warranty that it will be error-free, uninterrupted, or free of viruses

7. Disputes and Governing Law

Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the courts of Harris County, Texas.

Informal Resolution
Before initiating any formal legal proceedings, you agree to contact Fresh Turf directly to attempt to resolve the dispute informally. We will make good-faith efforts to address your concern within 14 business days of receiving your written notice.

Waiver of Class Action
You agree that any dispute shall be resolved individually and not as part of a class or representative action. You waive any right to participate in a class action lawsuit against Fresh Turf.

8. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify active customers via email. Your continued use of our services following notice of changes constitutes acceptance of the revised Terms.

It is your responsibility to review these Terms periodically. If you disagree with any updated Terms, you may cancel your maintenance plan or choose not to use our services going forward.
